HAOSASA TERMS AND CONDITIONS

Welcome to HAOSASA ("the Platform"). By accessing or using our mobile application or website, you agree to comply with and be bound by the following Terms and Conditions. If you do not agree to these terms, please do not use our services.

1. Definition of Services

HAOSASA acts strictly as an online marketplace and information directory connecting property owners/managers ("Landlords/Caretakers/Agents") with individuals seeking housing ("House Hunters/Property-Seekers"). HAOSASA does not own, manage, lease, sell, or control any of the properties listed on the platform.

2. User Accounts and Verification

• Eligibility: You must be at least 18 years old to create an account or list properties.

• Accuracy: Users agree to provide true, accurate, and complete information during registration and listing creation.

• Account Security: You are entirely responsible for maintaining the confidentiality of your login credentials. HAOSASA is not liable for unauthorized access to your account.

3. Listing Rules for Landlords

By uploading images, text, prices, and locations to HAOSASA, Landlords agree to the following rules:

• Authenticity: All listings must represent real, currently available properties. Bait-and-switch or fraudulent listings are strictly prohibited.

• Media Rights: Landlords must own or have the explicit legal right to use all images, descriptions, and materials uploaded from their devices.

4. Automatic Listing Expiration (The 2-Week Policy)

To keep the marketplace fresh, accurate, and active for all participants, HAOSASA enforces a strict listing duration policy:

• Two-Week Expiration: Any property listed on the platform that remains active for more than two (2) weeks will be automatically erased from the platform.

• Purpose: This automatic removal policy clears out old or filled spaces to give room and equal visibility to other users and fresh property listings.

• Exceptions: Listings will only be preserved past the two-week limit if the Landlord has established formal prior communication with HAOSASA management via haosasakenya@gmail.com and received an explicit extension.

• Re-listing: Landlords are welcome to re-list their properties if they are still vacant after the automatic removal occurs.

5. Safe Communication and Scam Prevention Rules

To protect our community, House Hunters must follow these strict safety protocols when communicating with Landlords:

• Mandatory Physical Confirmation: House Hunters must never, under any circumstances, pay any money (including viewing fees, deposits, or rent) for any room or property without first physically confirming the presence of the house and verifying the identity of the Landlord or agent in person.

• Financial Disclaimer: HAOSASA will never ask you to pay money through the app to secure a house. Any Landlord demanding immediate payment via mobile money or bank transfer prior to an in-person physical viewing should be treated as highly suspicious.

• Reporting Fraud: If a Landlord requests advance payments, provides misleading information, or acts suspiciously, House Hunters must immediately press the "Report Fraud" button located on the platform. Alternatively, you can report the user immediately by emailing haosasakenya@gmail.com with the listing details so our team can ban the fraudulent account.

6. Limitation of Liability and Disclaimers

• "As-Is" Basis: All content, listings, and property information are provided on an "as-is" and "as-available" basis. HAOSASA makes no guarantees regarding the safety, cleanliness, legality, or structural integrity of any property.

• User Interactions: HAOSASA is not a party to any rental agreements, lease contracts, or financial transactions negotiated between Landlords and House Hunters. Any disputes, financial losses, or property damages resulting from interactions between users are strictly the responsibility of the involved parties.

• No Endorsement: The inclusion of a property listing on HAOSASA does not constitute an endorsement or verification of that landlord or property by the Platform.

7. Prohibited Activities

Users agree NOT to use the platform to:

• Post false, misleading, defamatory, or unlawful content.

• Harass, scam, or defraud other users.

• Scrape, copy, or distribute platform data or listings without our explicit written permission.

8. Modifications to Service and Terms

HAOSASA reserves the right to modify, suspend, or discontinue any part of the service at any time. We may update these Terms and Conditions periodically, and your continued use of the app constitutes acceptance of the modified terms.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the local laws of the jurisdiction in which HAOSASA is legally registered and operating as an entity.
